The Technology, Education, and Copyright Harmonization (TEACH) Act of 2002 expands on Fair Use privileges by granting permission to display or show copyright works in online/distance education courses.
TEACH Act Guidelines for Usage
- The academic institution is accredited and non-profit.
- Display/show is part of class instructional activities.
- Usage is limited to the students in the course.
- Usage is either live or asynchronous.
- The academic institution has a developed and publicized copyright policy.
Not Covered under TEACH Act
- Electronic course reserves, coursepacks, or items retrieved via Interlibrary Loan.
- Textbooks and other electronic resources provided under license
- Converting print materials to electronic (unless digital version is unavailable).
- Copies made/retrieved illegally.
